Terms of use
This English version is provided for convenience. In case of any discrepancy, the German version prevails.
By using Noola you agree to these terms of use. Please read them carefully.
Scope
These terms apply to the use of the app and the website as well as the services offered under the name “Noola” (the “Service”) by the user. The provider is MT Hinz Ltd, Artas 15, 8250 Emba, Cyprus (the “Provider”). Contact: [email protected]. Deviating terms of the user are not recognised.
Subject matter and service
The Provider offers a platform-based application for organising contacts, reminders, notes and tasks, optionally connected to WhatsApp Business. The scope and availability of the services result from the respective product description and the chosen plan and may be adjusted in the course of technical development.
Plans
The Service is offered in three plans:
Free is free of charge and has no time limit. The number of contacts classified at the same time is limited; the current limit is shown in the app. A connection to WhatsApp is not included; a WhatsApp chat can be opened from the app via a direct link. Own storage space for files is not included.
Base is a paid plan and includes an unlimited number of classified contacts and own storage space for files in the stated amount.
Premium is a paid plan and, in addition to Base, includes the connection to WhatsApp Business, which allows messages to be read and sent in Noola, as well as storage space without a fixed quota. The WhatsApp connection requires a WhatsApp Business account of the user; WhatsApp’s terms also apply to its use.
Registration and user account
Registration is required to use the Service. The user provides truthful information and keeps it up to date. Login details must be kept secret. The user is liable for actions carried out via their account unless they prove misuse.
Obligations of the user
The user uses the Service only lawfully and within the agreed scope of use. They will not infringe the rights of third parties, will not post harmful or unlawful content and will observe the Provider’s usage and conduct guidelines. In the event of violations, the Provider is entitled to restrict or terminate access.
Trial
New users receive a one-time free 7-day trial with the full scope of Premium from registration. No payment details are required for the trial. It ends automatically and does not turn into a paid subscription. After it ends, the account continues on the Free plan unless the user takes out a paid plan. Contacts and notes are kept; an existing WhatsApp connection is ended.
Prices, payment and renewal
Base and Premium are offered as subscriptions with a monthly or yearly term. The prices shown in the respective store at the time of purchase apply, including statutory VAT.
The purchase is made as an in-app purchase via the Apple App Store or Google Play. Billing, renewal, cancellation and refunds are handled by the respective store; its terms apply in addition.
The subscription renews automatically for the chosen term unless it is cancelled before the end of the current period. Cancellation is done in the subscription settings of the respective store. After a paid subscription ends, the account continues on the Free plan.
Consumers have the statutory 14-day right of withdrawal after concluding a contract for the paid service; information on withdrawal is provided before the contract is concluded.
Changing plans
When switching to a plan with a smaller scope, stored data is kept. Contacts that are already classified remain classified; further classifications are only possible again once the number is below the limit of the new plan. Features not included in the new plan are no longer available from the time of the switch.
Existing customers
Users who took out a paid subscription before 1 October 2026 receive the scope of Premium at their previous price for the duration of that subscription.
Account deletion
The user can delete their account and all associated personal data at any time directly in the app under: Settings → Account → Delete account. After confirmation, the data is irrevocably deleted unless statutory retention obligations prevent this.
Alternatively, deletion can be requested by email to [email protected]. A subscription taken out via a store does not end automatically when the account is deleted and must be cancelled separately there.
Liability
The Provider is liable without limitation for intent and gross negligence as well as for injury to life, body or health. In the case of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations) and only up to the amount of foreseeable, typically occurring damage. Liability for lost profits and indirect damage remains excluded within the limits permitted by law.
Term and termination
Use is subject to the chosen plan and its term (Free without a term, trial, monthly or yearly subscription). The right to ordinary termination and to extraordinary termination for good cause remains unaffected. Upon termination, access to the account ends; the Provider may delete data after statutory retention periods have expired.
Intellectual property
All content, trademarks, logos, texts, graphics, software and other materials of the Service are the property of the Provider or licensed third parties and are protected by applicable copyright and trademark laws. Use of the Service does not grant the user any rights to these materials beyond use in accordance with the contract. In particular, it is prohibited to copy, distribute, modify or use content of the Service for one’s own commercial purposes without the Provider’s express written permission.
Content that the user enters into the Service themselves (e.g. contact details, messages, documents) remains the property of the user. The user grants the Provider the technically necessary right to store and process this content in order to provide the Service.
Final provisions
The law of the Republic of Cyprus applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence. The place of jurisdiction for disputes with businesses is Cyprus. Should individual clauses be invalid, the validity of the remaining provisions remains unaffected. Changes to these terms will be communicated; an objection entitles the user to extraordinary termination.
